Nevertheless, our society continues to maintain the current law system in order to avoid creating misled consequences. First of all, we can face an ineluctable situation in our lives easily. One good example associated with this situation is that people have basic rights to protect themselves from danger. If armed robberies invade a private property in order to rob or murder innocent people, they have to protect them from violence. In other words, in this case if people receive an unfair result from justice system, no one wants to comply with laws due to invasion of their basic rights. Another reason with maintaining a flexible law system is that judges should take into account criminals¡¯ motivation and situation when they commit a crime. For example, a taxi driver with a pregnant woman who is about to give a birth to baby offend a traffic laws in order to avoid a crucial situation for both woman and baby. In this case how can he is considered to a criminal so that laws need a flexibility to be clear some criminals¡¯ a false charge.
In conclusion, there are convincing arguments both for and against sentencing fixed punishment to offenders. But I am convinced that the advantages of flexible law system outweigh its drawbacks. |
